Practice Areas - VW DIESEL SCANDAL
You have probably read or heard about the Volkswagen TDI “clean diesel scandal that is rocking the automotive world. VW admits it put “defeat devices” into the software that controls the emissions systems on its TDI diesel engines. As a result, these cars pollute at a level from 15-40 times allowed by law. If you own one of these cars, you have been deceived by VW.
VW is still working on a “fix”. However, regardless of the fix, the value of your car has gone down, and will stay down - after you paid a premium for a “clean diesel” car. Typically, a VW Jetta with TDI diesel engines cost $2,500 more than the same car with a gas engine. The values of these cars have gone down by an average of 12% since the scandal broke on September 12, 2015, according to Kelly’s Blue Book. The values will probably continue to go down, and it is doubtful VW can make these TDI “clean diesels” pass emissions tests without a decrease in mileage and performance. They have not come up with a solution at this time.
If you bought a TDI (see list of affected vehicles below) you were deceived by VW into thinking you were buying a car that could perform, get great mileage and not pollute. So what is your remedy?
I am filing suits on behalf of VW TDI (and Audi A3) owners under the Consumer Protection Act (CPA) of Washington. These will not be class actions, but will be individual cases. 1 The CPA forbids “unfair or deceptive acts or practices”, and VW has all but admitted it deceived consumers. Therefore these are meritorious CPA cases. Once the court finds a violation, it will award damages (loss of value at a minimum) and in its discretion may treble (triple) the amount of damages and order VW to pay the attorney’s fees. If the suit is won, you will be compensated for the loss of value of your car. If we don’t win, you will owe nothing for attorney’s fees.

1. In class action cases, the individual often gets just a fraction of their damages, due to the costs of class action suits, and the attorneys fees. In individual cases filed under the CPA, you should get your actual damages in full, and these damages may be tripled by the judge.
